Expert Determination

AuctionsPlus are updating our User Agreement and Sale Terms. 

The information outlined in this article is effective as of the 1st March, 2023.

AuctionsPlus has worked to provide clarity across what, when, why and how issues must be reported to be considered a claim. Furthermore, our goal has been to continue to provide fair support and a neutral position whilst disputes are resolved. We believe clarity and confidence are key to continued trust in the platform.

Expert determination will be replacing the current Arbitration process.

If a valid claim is not settled through dispute resolution via negotiation or meditation, the matter can be referred to expert determination.

The Expert Determination process includes:

  • Each party makes payment of fixed sum of $1,000 + GST.
  • Any costs and expenses of the expert determination are borne and paid equally by both parties.
  • The expert determination shall be administered by AuctionsPlus, but the expert determination will be conducted by three external experts.
  • The identity of the experts and the identity of the parties in the dispute will not be disclosed.
  • Payment of the lot is made to AuctionsPlus and held in trust, for the full amount as per the invoice for the stock at the sale price.
  • The determination will be provided to both parties as soon as reasonably practical after the determination is made, and funds will be distributed as per the findings.
