Our User Agreement specifies our Dispute Resolution Framework for Assessed, Described and Forward+ Lots.
1. Negotiation
- Buyer must notify either the Selling Agent, Vendor or AuctionsPlus of the Defect within 48 hours of delivery in writing.
- Must include the nature of the Defect
- Legal and factual issues involved e.g. photos and videos.
- Resolution they are seeking
2. Mediation
If buyers and sellers are unable to reach a resolution through negotiation they will then have the opportunity to proceed to mediation.
- Mediation involves a 3rd party who will help parties involved: discuss the disputed options, consider alternatives and endeavor to reach an mutual agreement.
- The implementation of mediation would have the goal of reaching a resolution in a quick, fair and cost effective way for all involved
3. Expert Determination
If a resolution is still unable to be reached through mediation, the buyer may have the ability to reject the animals as set out in the dispute schedule or the claim can be referred to Expert determination.
- Expert Determination (formerly known as Arbitration) involves an independent panel determination of the resolution of the dispute
- Cost of $1,000 ex GST per party
The buyers ability to reject stock or seek a price adjustment following a claim is set out in schedule three of the updated user agreement.
