AuctionsPlus are updating our User Agreement and Sale Terms.
The information outlined in this article is effective as of the 1st June, 2024.
From the 1st June 2024, all registered AuctionsPlus users will need to read and accept the updated User Agreement & Sale Terms to continue using the website.
You will be able to do this via a pop-up that will appear when you log in to the AuctionsPlus website from the 1st of June 2024.
The updated terms must be accepted for you to continue using the website.
Why are the Terms Changing?
AuctionsPlus has embarked on an uplift of our User Agreement and Sale Terms to further define and enhance the rules, protections, and platform governance. The Terms have aged, and the business has grown, which requires us to ensure that the Terms are fit for purpose.
These Terms have been designed by our network and our buyers, in conjunction with our lived experience in managing transactions on our platform and were written by external legal counsel.
The updated User Agreement & Sale Terms will provide a higher level of transparency and ensure buyers can purchase with even greater confidence.
What is Changing?
Animal Health Scenario 3:
In cases where any percentage of animals are showing symptoms of a transmittable disease, it is acceptable that all will, or there is a significant risk all will, have the underlying cause present.
If symptoms of a transmittable disease are detected within 48 hours of delivery to the buyer and confirmed by a qualified Veterinarian within 7 days of detection, and the disease was acquired by the animals before delivery to the buyer, then the Buyer may reject the entire Lot.
The Assessor has the right to attend the Veterinarian inspection and should not be prohibited from reasonable access to the livestock.
Weight – Live Weight:
Claims relating to weight may only be sought by the Buyer in the following circumstances:
A Buyer may make a claim based on average live weight or weight range, not both.
In the absence of a recorded weighbridge weight, unless agreed otherwise by both parties, AuctionsPlus will require a Re-weigh Process to be completed.
The Vendor has the right to nominate a third party to attend the re-weigh and should not be prohibited from reasonable access to the livestock.
Slaughter Stock:
Before the end of 48 hours following slaughter, notify the Selling Agent, Vendor, or AuctionsPlus of the claim in writing.
For livestock slaughtered on the final Business Day of the week, notify the relevant parties before 17:00 on the end of 2 Business Days following slaughter.
Business Day is determined by the State or Territory where the Lot is delivered to the Buyer.
Take photographs of the carcasses or videos of the slaughter or grading process if requested by AuctionsPlus.
What’s New?
Re-Weigh Process:
The Re-Weigh Process is a 7-day process following the Delivery to the Buyer where on the 7th day, the livestock are re-weighed.
Over the 7 days, the livestock must be kept on equivalent feed and fresh water to that of the original assessment and must not be inducted.
The livestock should be re-weighed in accordance with the original assessments’ curfew.
