The information outlined in this article is effective as of the 1st March, 2023.
The AuctionsPlus Terms indicate that for the majority of claims to be made they must be reported in writing within 48 hours (to AuctionsPlus or the Selling Agent).
However, there are some specific situations in which claims may be made outside 48 hours.
AuctionsPlus still expect buyers to thoroughly inspect a lot upon arrival to their property - however, there are circumstances where it is not practical or possible for the buyer to get the information within this period.
There are several situations where we have reviewed and outlined a new reporting timeframe for specific claims to fairly account for when information may come to light.
Defined Traits of unborn progeny (breed, sex)
The claim must be notified within the following timeframes:
- If relating to wrong sex (for example from sexed embryo's or sexed semen), then within 7 days from birth;
- If relating to breed inaccuracies (progeny breed) evidenced by coat colour (e.g. Dorpers or Black Baldies), then within 7 days from birth; OR
- If relating to breed inaccuracies (progeny breed) that cannot be identified at birth, then 3 months from end of calving/lambing.
If more than 5% of the entire Lot has problems with these Defined Traits, the Buyer may raise a claim and seek a resolution.
If more than 15% of the entire Lot (not including unborn progeny) has problems with these Defined Traits, the Buyer may reject the entire Lot.
Progeny born outside expected timeframe
This applies to progeny born (full term) at least 2 weeks outside the expected timeframe – based on joining dates, not term in months (unless continuously joined). Stated as no other access to sires.
The claim must be notified within 7 days of birth, however if progeny are born after the expected timeframe, buyers have 7 days from the end of that expected window.
There is a 5% tolerance on the number of progeny which can be born outside the expected timeframe. If this tolerance is exceeded, the Buyer may raise a claim and seek a resolution.
Specific Sire Details or Bloodlines (for assessed animals, progeny at foot or unborn progeny)
The Buyer must inform the Vender, Selling Agent or AuctionsPlus when the genetic testing occurs.
The claim must be notified and evidence provided within 3 months from delivery to the Buyer (for live animals) or 3 months from end of calving or lambing (for unborn progeny).
Lifetime Traceability/EU/Other NLIS inaccuracies
The claim must be notified within the timeframe of NLIS transfer requirements of the State of the purchase.
A 1% tolerance exists, and a buyer may claim on any animals in excess of this.
